Terms of Use

Website Purpose

This website allows prospective and existing clients to:

• request styling appointments;
• provide styling preferences and other information relevant to the requested service;
• receive appointment-related communications;
• access a private Style Profile; and
• communicate with Kayla about styling services.

Information provided through the website is for general informational, scheduling, and service-preparation purposes. It does not guarantee appointment availability, acceptance of an appointment request, product availability, or any particular styling result.

Appointment Requests and Confirmation

Submitting an appointment request does not create a confirmed appointment. An appointment is confirmed only when Kayla confirms the date and time in writing.

Kayla may accept or decline a request or suggest a different appointment time. You are responsible for reviewing your appointment details and promptly reporting any error.

We may decline, cancel, end, or discontinue services when reasonably necessary, including because of scheduling conflicts, safety concerns, inappropriate conduct, inaccurate or incomplete information, nonpayment of an amount properly due, or circumstances that prevent the service from being performed appropriately.

Client Information and Privacy

You agree to provide information that is accurate, current, and reasonably complete when requesting an appointment or completing a client profile. You are responsible for updating information that materially affects the requested service, including changes to your contact details, measurements, styling needs, schedule, or relevant limitations.

Our collection, use, retention, and protection of personal information are described in the Client Information and Privacy Notice, which is incorporated into these Terms by reference.

Agreeing to these Terms or acknowledging the Privacy Notice does not authorize marketing messages or the public use of your photographs, name, testimonial, or identifying information. Those uses require separate permission when applicable.

Private Style Profile Links

Confirmed clients may receive a private Style Profile link. The link is intended only for the client to whom it is issued. You must not publish, forward, or share the link or knowingly permit unauthorized access to it.

A Style Profile link may expire 30 days after it is issued. Expiration of the link does not necessarily mean the associated client records have been deleted.

Please notify Kayla promptly if you believe a private link or client profile has been accessed without authorization.

Cancellations, Rescheduling, and Late Arrivals

You may request to cancel or reschedule an appointment by contacting Kayla by email or phone. A rescheduling request is not effective until the new appointment time is confirmed in writing.

Unless a different policy is disclosed during booking:

• please arrive on time and prepared for your appointment;
• a late arrival may reduce the available service time or require rescheduling;
• a delay of more than 30 minutes may be treated as a late cancellation or no-show; and
• repeated late cancellations or no-shows may result in refusal of future bookings.

If a paid service, deposit, or cancellation charge applies, the applicable amount and policy will be disclosed before it becomes binding.

We may cancel or reschedule an appointment because of illness, emergency, unsafe conditions, severe weather, scheduling conflicts, or other circumstances beyond our reasonable control. When payment has been made for a service we cannot provide, our primary obligation will be to offer a reasonable rescheduling option or refund the amount paid for the unprovided service.

Except where prohibited by law, we are not responsible for incidental expenses caused by a cancellation or rescheduling, including travel, lodging, childcare, lost wages, or third-party costs.

Client Conduct

You agree to communicate and behave respectfully toward Kayla, store or venue personnel, contractors, other clients, and members of the public.

Prohibited conduct includes:

• harassment, threats, intimidation, discrimination, or abusive language;
• sexual misconduct or unwelcome sexual behavior;
• violence or conduct that creates a safety risk;
• intentional property damage;
• recording, photographing, or publishing private interactions without permission;
• fraud, deliberate nonpayment, or abusive chargebacks;
• providing materially false or misleading information;
• sharing another client’s private information or Style Profile; and
• unlawful, disruptive, or otherwise inappropriate conduct in the service environment.

We may immediately end an appointment, restrict website access, cancel future bookings, or refuse service when we reasonably believe prohibited conduct has occurred. Amounts already paid may be nonrefundable when an appointment is ended because of client misconduct, to the extent permitted by law and any disclosed payment policy.

Styling Recommendations and Client Decisions

Styling services involve professional judgment, personal preferences, and subjective results. Recommendations may be based on the information you provide, available merchandise, fit, color, budget, lifestyle, personal presentation, and other relevant factors.

We do not guarantee that a recommendation, product, outfit, or styling result will meet every expectation or produce a specific personal, social, professional, or financial outcome.

You remain responsible for deciding whether to purchase, wear, use, alter, return, or rely on a recommended item. We are not responsible for the quality, availability, sizing, pricing, shipping, performance, safety, or return policies of products sold by third parties.

Photographs, Testimonials, and Marketing

Your photographs, name, testimonial, and identifying information will not be used publicly for advertising or promotion solely because you agreed to these Terms.

Any public or promotional use that requires permission will be addressed through a separate authorization. You may withdraw permission for future use as described in that authorization, although withdrawal may not affect material already lawfully published or distributed.

Intellectual Property

The website and its original branding, graphics, text, layouts, questionnaires, styling materials, and other content are owned by or licensed to Style with Kayla and are protected by applicable intellectual-property laws.

You may use materials provided to you for your personal, noncommercial use. Without prior written permission, you may not:

• copy, republish, sell, license, distribute, or commercially exploit our content;
• remove copyright, trademark, or ownership notices;
• use our branding in a misleading manner;
• reproduce private client materials for another person; or
• scrape, reverse engineer, circumvent, or interfere with website systems.

All rights not expressly granted are reserved.

Third-Party Services and Links

The website may use or link to third-party services, including hosting, scheduling, communications, analytics, retail, payment, and social-media platforms.

We do not control third-party websites, products, services, content, privacy practices, availability, or terms. Your use of a third-party service may be governed by that provider’s own terms and policies.

Website Availability, Security, and Acceptable Use

We may update, suspend, restrict, or discontinue any part of the website. We use reasonable safeguards intended to protect the website and client information, but no website, database, communication method, or electronic storage system can be guaranteed to be completely secure or continuously available.

You are responsible for protecting any device, email account, password, or private link you use to access website features.

You may not use the website to:

• engage in unlawful or fraudulent activity;
• impersonate another person or materially misrepresent your identity;
• access or attempt to access another person’s profile, private information, account, database, or restricted system without authorization;
• introduce malicious code or interfere with website operation or security;
• collect information about other users without authorization;
• circumvent access controls; or
• infringe another person’s legal rights.

We may restrict access or take other appropriate action in response to suspected misuse.

Disclaimer of Warranties

To the fullest extent permitted by law, the website and related content are provided on an “as is” and “as available” basis.

We do not promise that the website will always be uninterrupted, error-free, or secure; that all information will always be complete or current; that an appointment request will be accepted; that styling recommendations will produce a particular result; or that third-party products and services will meet your expectations.

Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, Style with Kayla will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:

• your use of or inability to use the website;
• appointment delays, cancellations, or rescheduling;
• styling recommendations or subjective dissatisfaction;
• third-party products, services, websites, or vendors;
• loss of data, income, business opportunity, or reputation; or
• unauthorized access occurring despite reasonable safeguards.

To the fullest extent permitted by law, our total liability arising from a particular appointment or transaction will not exceed the amount you paid directly to Style with Kayla for the service giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability for intentional misconduct where applicable law prohibits limitation.

Indemnification

To the extent permitted by law, you agree to reimburse Style with Kayla for reasonable losses, liabilities, damages, costs, and expenses arising from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, unlawful submission of information or materials, or intentional fraudulent misconduct.

This section does not require you to indemnify us for our own unlawful conduct.

Suspension, Termination, or Refusal of Service

We may suspend or terminate access to website features or refuse future services when reasonably necessary because of a violation of these Terms, nonpayment, fraud or suspected fraud, safety concerns, harassment, prohibited conduct, misuse of private links or client information, or legal or operational requirements.

Provisions that by their nature should continue after termination will remain effective, including provisions concerning payment, intellectual property, disclaimers, liability, and disputes.

Governing Law and Venue

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles.

Subject to any venue or consumer-protection right that cannot lawfully be waived, a legal proceeding arising from these Terms or the services must be brought in a state or federal court located in Ada County, Idaho. You and Style with Kayla consent to the personal jurisdiction of those courts.

Informal Dispute Resolution

Before filing a lawsuit, please contact us at kaylasreynolds@gmail.com with a written description of the dispute and the resolution you are requesting. Both parties agree to make a good-faith effort to resolve the matter informally.

This section does not prevent either party from seeking emergency relief, bringing an eligible claim in small-claims court, or exercising a right that cannot legally be restricted.

Changes to These Terms

We may update these Terms to reflect changes in our services, business practices, technology, or legal requirements. Updated Terms will be posted with a revised effective date. Material changes may also be communicated through the website or directly to affected clients when appropriate.

Changes apply prospectively unless otherwise permitted by law.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. An unenforceable provision will be interpreted or narrowed only as much as necessary to make it enforceable where legally permitted.

Entire Agreement

These Terms, the Client Information and Privacy Notice, any disclosed cancellation or payment terms, and any separately signed service agreement or authorization constitute the agreement governing your use of the website and styling services.

If a separately signed agreement directly conflicts with these Terms, the separately signed agreement controls for the specific subject it addresses.
